House rules and general terms and conditions

Dear guests,


A warm welcome to you! We are delighted that you are our guests.


To keep this house as beautiful as it is, we ask you to observe the following house rules:


- Smoking is strictly prohibited throughout the house

- Eating is not allowed in the bedrooms

- Do not wear street shoes/ski boots or mountain boots in the house

- Candles must be supervised

- Beds are only to be used with full bed linen

- Skis and snowboards must be stored outside the house

- Please separate waste into residual waste, paper, packaging and glass.

- Quiet time from 10 pm


- The house and the surrounding area must be kept clean

- Water, electricity and heating are expensive. Please use them sparingly.

- Windows must be closed when you are away

- Rooms must not be cooled down in order to heat them up again afterwards.


- Please ventilate (several times) daily (keep all windows and doors open simultaneously for about 3-5 minutes and then close them.

- Pets are not permitted

- If the house is left in a very dirty condition, you will be charged for the additional cleaning work.


Arrival: from 3 p.m., departure until 10 a.m.


Toboggans/bobsleds/sledges are available free of charge on request. Please return them after use.

General Terms and Conditions


General Terms and Conditions (AGB) 


Landlord: Dr. Elisabeth Blau, Obersteinstraße 1, 5522 St. Martin am Tennengebirge


1. arrival / departure

Guests can check in independently. Approximately one week before arrival, the hostess will send a link to the pre-check-in which must be filled out for ALL persons traveling with you due to the Austrian registration law. Only if the online pre-check-in has been completed will guests receive the code for the key safe on the day of arrival. Guests can arrive from 15:00 on the day of arrival. Departure must be no later than 09:00 (morning) on the day of departure. If the departure time is exceeded by more than 30 minutes, an additional night will be charged.

Other arrival and departure times can be agreed individually with the landlord. If the tenant does not show up on the day of arrival, the contract shall be deemed terminated after a period of 48 hours without notification to the landlord. The landlord or his representative may then freely dispose of the property. A (pro rata) refund of the rent due to early departure will not be made.

On the day of arrival, the tenant will receive a key code for the rental property in exchange for the registration data (see “5. Obligations of the tenant”).

3. Payment

The rental agreement becomes valid upon receipt of the deposit to the landlord's account. The deposit of 25% of the rental amount is due for payment within seven days of receipt of the booking documents. After the down payment has been made, payment of the remaining amount is due 30 days before departure. If the payment deadlines are not met, the landlord may withdraw from the contract. Non-payment is deemed to be a withdrawal and entitles the tenant to re-let the property.

The ancillary costs for electricity will be charged additionally. The energy costs are charged according to consumption. The price per kWh is stated in the booking documents.

4. withdrawal

You can withdraw from the contract at any time. The withdrawal must be made in writing. In the event of withdrawal, you are obliged to compensate us for the damage incurred:

In each case, the date of receipt of your notice of withdrawal counts. Amounts already paid will be offset. You can provide a replacement person who enters into your contract under the above conditions.

In such a case, a new rental contract will be drawn up so that rights and obligations are transferred to the new tenant. As soon as the deposit or total price has been paid by the new tenant, depending on the time, the tenant waiving the rental agreement will also receive a 100% refund of the costs already paid.


4.1 Cancellations due to Covid

4.1.1 Cancellation in the event of entry ban / accommodation ban
In the event of an entry ban or accommodation ban, the host or guest must cancel in writing.
In the event of a ban on entry or accommodation at the planned travel time, the provision of services (i.e. rental) is impossible for the landlord, therefore the
landlord will refund 100% of the payments already made, regardless of whether the written cancellation was made by the host or the guest.
4.1.2 Cancellation in the event of illness, fear of corona, quarantine, etc.
If the landlord can and may provide his service (rental), but the guest cancels for personal reasons (including illness, fear of corona, quarantine, increasing corona case numbers, etc.), the cancellation conditions of the landlord's general terms and conditions apply. The General Terms and Conditions also apply if the tenant is not allowed to leave the country due to national regulations.
Travel cancellation insurance is therefore recommended.


5 Obligations of the tenant

The tenant undertakes to treat the rented property (vacation home, inventory and outdoor facilities) with care. If damage occurs to the vacation home and/or its inventory during the tenancy, the tenant is obliged to report this immediately to the landlord. 

Defects and damage discovered on arrival must be reported to the landlord immediately, otherwise the tenant is liable for this damage. A reasonable period of time must be allowed for the rectification of damage and defects. Claims arising from complaints that are not reported immediately on site are excluded. Complaints that are only received by the landlord at the end of the stay or after leaving the vacation home are also excluded from compensation. In the event of any service disruptions, the tenant is obliged to do everything reasonable within the scope of his legal obligation to contribute to rectifying the disruption and to minimize any damage incurred. On the day of departure, the tenant must remove personal belongings, dispose of household waste in the bins provided outside the house and store clean and washed dishes in the kitchen cupboards.

   

Due to the legally prescribed registration obligation, the landlord is obliged to report the tenant's registration data to the municipal office in full, on time and correctly. In order to facilitate the registration process, the tenant will receive a link to fill in the registration data before arrival. This form must be completed, signed and returned to the landlord before arrival (to [email protected]) so that the landlord can forward this form to the registration office.

If the house is left in a very dirty condition, the additional cleaning costs will be charged. Due to the fact that waste separation is compulsory at Obertauern, and compliance is also checked by the waste company and possibly penalized by charges, we have to pass these charges on to guests. For waste that has not been thrown separately into the garbage bag, we must therefore pass on the costs of € 20 / bag. Smoking is strictly prohibited in the house. If smoking is nevertheless permitted, additional cleaning charges will be incurred.

The tenant is obliged to use water, electricity and heating carefully. The house should be ventilated several times a day (i.e. windows and doors in the house are opened simultaneously for about 3 - 5 minutes to exchange the air and maintain the room temperature).

When leaving the house, all windows must be closed.

If rooms are cooled down to less than 16 degrees during the day or night, a payment of €20 or more is due. In this way, additional heating costs incurred by leaving windows open for hours while the heating is fully turned up, for example, are passed on to the guest. Unfortunately, this measure has become necessary because resources have been used so carelessly in the past and pellets have become extremely expensive.

6. data protection

The tenant agrees that necessary personal data may be stored, changed and/or deleted in the context of the contract concluded with him. All personal data will be treated with absolute confidentiality.

7. liability

The advertisement has been prepared to the best of our knowledge. We are not liable for any influence on the rental property due to force majeure, due to the usual Internet, power and water failures and storms. Similarly, no liability is accepted in the event of unforeseeable or unavoidable circumstances such as official orders, sudden construction sites or disruptions caused by natural and local conditions. The lessor shall endeavor to assist in remedying the problems (insofar as this is possible).

The landlord accepts no liability for the use of the play and sports equipment provided. The arrival and departure of the hirer is at their own risk and liability. The landlord is not liable for personal belongings in the event of theft or fire. The hirer is fully liable for willful destruction or damage.

The landlord assumes no liability for the offers of other providers (e.g. sports and outdoor program providers).


8. final provisions

Photos and text on the website or in the flyer serve as a realistic description. The 100% correspondence with the rental property cannot be guaranteed. The landlord reserves the right to make changes to the furnishings (e.g. furniture), provided they are of equal value.

Should one or more provisions of these terms and conditions be or become invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid provision that comes closest to the economic and legal intentions of the contracting parties.

Austrian law shall apply. The place of jurisdiction and place of fulfillment is the place of residence of the lessor.
